END-USER LICENSE AGREEMENT FOR THIS SOFTWARE

THIS IS A CONTRACT. PLEASE READ IT CAREFULLY. BY INSTALLING, USING OR COPYING THE SOFTWARE PROGRAM YOU ACKNOWLEDGE THAT YOU HAVE READ AND ACCEPT THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL, COPY, OR USE THE SOFTWARE PROGRAM.
This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you (meaning the person or the entity that obtained the Software under the terms and conditions of this EULA, is agreeing to be bound by the terms and conditions of this EULA, and is referred to below as "USER" or "You") and the author of this Software - Rastislav Korytár, www.rksoft.sk ("AUTHOR"), for this software product ("SOFTWARE").
The SOFTWARE is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE is licensed, not sold.

1. GRANT OF LICENSE
AUTHOR grants you a limited, non-exclusive license ("LICENSE") to use the SOFTWARE, as indicated herein."Use" means storing, loading, installing, executing or displaying the SOFTWARE.

You MAY:
a) install and use the SOFTWARE in FREE mode with limited features as long as you wish;
b) after purchasing a LICENSE and receiving a Activation Code, activate the SOFTWARE with the Activation Code and use the activated Software, with extended features, on a single (one) computer per purchased LICENSE (a single Activation Code may correspond to one or more LICENSES);
c) for a Activation Code valid for one LICENSE, activate SOFTWARE on another your computer as long as you first deactivate the currently activated SOFTWARE;
d) for a Activation Code valid for two or more LICENSES, activate and deactivate SOFTWARE on other your computers as long as the total number of activated copies of SOFTWARE does not exceed the number of purchased licenses.

2. RESTRICTIONS
You MAY NOT:
a) sell, sublicense, lease or transfer this SOFTWARE to another;
b) distribute the SOFTWARE without a written agreement with AUTHOR;
d) cause or permit reverse engineering, disassembly, decompilation or alteration of this SOFTWARE;
e) remove any product identification, copyright notices, or other notices or proprietary restrictions from this SOFTWARE;

3. INTERNET CONNECTION REQUIREMENTS
You can activate and deactivate a SOFTWARE any number of times for free (i.e. at no cost for you) as long as the computer on which the activation or deactivation is performed is connected to the Internet. An Internet connection is not required once the Software is activated.

4. COPYRIGHT/OWNERSHIP
This SOFTWARE and its source code are proprietary products of AUTHOR and are protected by copyright and other intellectual property laws. The SOFTWARE is licensed and not sold. You acquire only the right to use the SOFTWARE and do not acquire any rights, express or implied, in the SOFTWARE other than those specified in this EULA. Interaction or inclusion of parts of the SOFTWARE in third-party products does not mean that the SOFTWARE, or any portion of it, is part of these products nor property of the companies owning these products.

5. INNOVATIONS
After installation of newer version of the SOFTWARE is the previous EULA considered null and void. With release of newer version of the SOFTWARE any of the AUTHOR’s commitments for support and further development of older versions of SOFTWARE are automatically terminated.

6. END USER DECLARATIONS. AS THE END USER YOU ACKNOWLEDGE THAT THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NEITHER THE PROVIDER, ITS LICENSORS OR AFFILIATES NOR THE COPYRIGHT HOLDERS MAKE ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE SOFTWARE WILL NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS OR OTHER RIGHTS. THERE IS NO WARRANTY BY THE PROVIDER OR BY ANY OTHER PARTY THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR THE SELECTION OF THE SOFTWARE TO ACHIEVE YOUR INTENDED RESULTS AND FOR THE INSTALLATION, USE AND RESULTS OBTAINED FROM IT.

7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER, ITS EMPLOYEES OR LICENSORS BE LIABLE FOR ANY LOST PROFITS, REVENUE, SALES, DATA OR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, PROPERTY DAMAGE, PERSONAL INJURY, INTERRUPTION OF BUSINESS, LOSS OF BUSINESS INFORMATION OR FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, ECONOMIC, COVER, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND WHETHER ARISING UNDER CONTRACT, TORT, NEGLIGENCE OR OTHER THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE PROVIDER OR ITS LICENSORS OR AFFILIATES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME COUNTRIES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF LIABILITY, BUT MAY ALLOW LIABILITY TO BE LIMITED, IN SUCH CASES, THE LIABILITY OF THE PROVIDER, ITS EMPLOYEES OR LICENSORS OR AFFILIATES SHALL BE LIMITED TO THE SUM THAT YOU PAID FOR THE LICENSE.

8. TERM
This EULA is effective until terminated. You may terminate it at any time by destroying the SOFTWARE, together with all copies thereof. This EULA will also terminate if You fail to comply with any term or condition of this Agreement. Upon such termination, You agree to destroy the SOFTWARE, together with all copies thereof.

9. APPLICABLE LAW
This EULA shall be governed by and construed in accordance with the laws of the Slovak Republic. The USER and the AUTHOR hereby agree that the principles of the conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods shall not apply. You expressly agree that any disputes or claims ensuing from this EULA with respect to the AUTHOR or any disputes or claims relating to use of the Software shall be settled by District Court in Nové Mesto nad Váhom, Slovak republic and You expressly agree to the said court exercising jurisdiction.

10. GENERAL PROVISIONS
The original language of this EULA is Slovak. In case of conflicts between the original Slovak version and any translation, the Slovak version shall prevail. Should any of the provisions of this EULA be invalid or unenforceable, this shall not affect the validity of the other provisions of the EULA, which shall remain valid and enforceable in accordance with the conditions stipulated therein. This is the entire EULA between the Author and You relating to the Software and it supersedes any prior representations, discussions, undertakings, communications or advertising relating to the Software.
