NTFS Permissions Auditor License agreement
Before you use NTFS Permissions Auditor software, please read this agreement. You may use this software only as described in this license.
1. SOFTWARE
The capitalized term 'Software' used below refers to NTFS Permissions Auditor, any updates to the software, any supplemental code provided to you by Albus Bit SIA, the user manual, any associated software components, any related media and printed materials, and any 'online' or electronic documentation.
2. COPYRIGHT
The Software is copyright 2018, Albus Bit SIA. The Software is licensed, not sold.
3. FREE VERSION
You may use the Software without any charge. Free software provided under this section is provided 'as is' and unsupported. You may report bug, send feedback to Albus Bit, but Albus Bit does not guarantee support. You may use the Software on as many different computers as you like.
4. BETA VERSION
The provisions of this section shall apply to Software downloaded for beta testing.
4.1 Beta License. Subject to the terms and conditions of this Agreement, Albus Bit hereby grants to Licensee, and Licensee accepts from Albus Bit, a limited, nontransferable, non-exclusive license to use the Software solely for the purpose of testing the Software internally and evaluating the Software for the purpose of providing Feedback to Albus Bit. The Software is licensed, not sold to Licensee by Albus Bit, for a maximum beta testing period of ninety (90) days from the Software installation date ('Beta Test Period').
4.2 Feedback. Licensee agrees to provide to Albus Bit reasonable suggestions, comments and feedback regarding beta Software, including but not limited to usability, bug reports and test results, with respect to Software testing (collectively, “Feedback”). Licensee grants to Albus Bit, under Licensee’s intellectual property and proprietary rights, the following worldwide, non-exclusive, perpetual, irrevocable, royalty free, fully paid up rights: to make, use, copy, modify, create derivative works of, publicly perform or display, import, broadcast, transmit, distribute, license, sublicense, offer to sell, and sell, rent, lease or lend copies of the Feedback as part of any Albus Bit product, technology, service, specification or other documentation. Further, you warrant that your Feedback is not subject to license terms that will require, or claim to require, that any Albus Bit product, technology, or service that incorporates any Feedback (or any intellectual property therein) be licensed to or from any third party on specified terms. Due to the nature of the development work, Albus Bit provides no assurance that any specific errors or discrepancies in the Software will be corrected.
4.3 Acknowledgements and Additional Liability Limitation and Warranty Disclaimer. Licensee acknowledges that all Software designated as beta Software may contain bugs, may not operate properly or perform all intended functions, may interfere with the functioning of other software applications, and may cause errors, data loss or other problems, and may not be upgraded to a production version. Accordingly, Licensee acknowledges and agrees that Software designated as beta Software is not production ready and should not be used in a live production environment. Licensee acknowledges that use of beta Software is voluntary. LICENSEE AND ALBUS BIT AGREE THAT THE BETA SOFTWARE PROVIDED UNDER THIS SECTION IS PROVIDED 'AS IS' AND UNSUPPORTED, AND THAT ALBUS BIT MAKES NO WARRANTY AS TO THE BETA SOFTWARE, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE.
5. REGISTERED VERSION
Upon enabling (or installing) the registered copy, you may use the Software on that number of computers for which you have paid a separate license fee, and the primary user of each computer for which you have paid a separate license fee may use the Software both on his or her portable device and personal computer at home. You may also make one copy of the Software for backup or archival purposes. Otherwise, you may not copy the registered Software in whole or in part. If the registered copy of the Software is installed on a network server or other storage device, you must purchase a license for each separate computer on which the Software is used. A license for the Software may not be shared by alternating use of the Software between different computers. You may permanently transfer all of your rights to the registered copy of the Software under this license provided you transfer all copies of the Software and the recipient agrees to the terms of this license. All rights not expressly granted under this license are reserved by Albus Bit SIA.
6. DISCLAIMER
THIS SOFTWARE IS PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY DAMAGES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OF THIS SOFTWARE, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS.
7. LICENSE ACTIVATION AND VALIDATION
The Software may attempt to contact remote servers over the Internet in order to complete the license activation process and validate the right to use the Software on this machine. No personally identifiable information will be transmitted during this process, except to the extent that IP address may be considered personally identifiable in some jurisdictions. BY USING THE SOFTWARE, YOU CONSENT TO THE TRANSMISSION OF THIS INFORMATION.
8. DISTRIBUTION
The Software may be distributed freely in its original unmodified and unregistered form. The distribution has to include all files of its original distribution. Distributors may not charge any money for it.
9. LIMITATIONS ON REVERSE ENGINEERING, DECOMPILATION, AND DISASSEMBLY
You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
10. NO RENTAL/COMMERCIAL HOSTING/SOFTWARE TRANSFER
You may not rent, lease, lend or provide commercial hosting services with the Software. You may not assign or otherwise transfer the Software or any of your rights hereunder to any third party unless authorized by Albus Bit SIA.
11. TERMINATION
This license terminates if you fail to comply with its terms and conditions. If your license terminates, you must destroy all copies of the Software you have. The termination of this license does not limit other rights that Albus Bit SIA may have by law.
